CONDITIONS OF OWNERSHIP AND ADDITIONAL RESTRICTIONS FOR LAKE FRONTAGE LOTS (25-72 inclusive)

1. Each lot owner shall hold title to a 1/48th interest in the lake and dam area. Said "Lake and Dam" area shall be shown on the recorded plat of Northern Hills Second Subdivision.

2. An easement for the spillway channel through the Wastewater Treatment Plant site shall also be held by the owners of the lake frontage lots.

3. Northern Hills Development will hold and retain an easement through the dam area for water and sewer lines.

4. Owners of the lake frontage lots shall meet annually to elect a representative who will be empowered to speak for the group. Each lot shall be accorded one vote in all matters which come before the group. The majority of votes will decide issues.

5. The elected owners representative shall be paid by the group and shall be responsible for the maintenance, inspection, and safety of the lake and dam. He shall be authorized to expend funds for these purposes within the limits imposed by the group.

6. All lake frontage owners shall share the expenses of maintenance, etc. for the lake and dam according to their 1/48th interest.

7. Piers shall not be constructed in the lake which are longer than 18 feet (projection out into water), wider than 4 feet per lot, or have an elevation higher than 16 inches above normal pool elevation.

8. The lake shoreline as delineated on the subdivision plat is not to be altered in any way except by the addition of sand or other such material to improve the surface.

9. No motors shall be allowed on any boats on the lake with the exception of electrically driven trolling motors.

10. Fish stocking shall be the responsibility of the lake frontage lot owners. .

11. No commercial fishing of any type shall be allowed on the lake.

12. These conditions of ownership and reservations for the lake frontage lots can be added to or changed only by approval of all of the owners of lake frontage lots.
